These Terms of Service (“Terms”) govern your access to and use of Thunder’s website, platform, and related software tools. By using Thunder, you agree to these Terms. If you do not agree, do not use Thunder.
“Thunder,” “we,” “us,” or “our” means Thunder Systems, Inc. “You” means the individual or organization using Thunder.
Thunder provides software tools for analyzing, managing, and operating advertising and marketing workflows. The platform may connect to third-party systems, including advertising platforms, CRM systems, analytics tools, and other business applications, when you authorize us to do so.
Thunder may separately provide managed advertising, consulting, or other services under a written agreement with a customer. Those services are governed by the applicable written agreement, not these Terms, except where that agreement says otherwise.
You may need an account to use parts of Thunder. You agree to provide accurate information, keep your login credentials secure, and be responsible for activity under your account.
By connecting a third-party account, you authorize Thunder to access, process, and, where permitted by the permissions you grant, take actions in that account through the Thunder platform.
You represent that you have the necessary rights and authority to connect those accounts and authorize Thunder to access them. Your use of third-party platforms remains subject to their own terms and policies.

You agree not to use Thunder for unlawful, harmful, or fraudulent purposes, interfere with the platform, attempt unauthorized access, upload malicious code, reverse engineer the platform except as allowed by law, or use Thunder to build a competing product or service.
Thunder does not guarantee advertising results, platform approvals, lead volume, revenue, return on ad spend, or other business outcomes.
You retain ownership of the data you submit to or connect with Thunder. You grant Thunder permission to use that data as needed to provide, maintain, secure, and improve the platform.
Our Privacy Policy explains how we collect, use, store, and protect data, including data from connected advertising and business platforms.
Thunder and its platform, software, documentation, content, and related materials are owned by Thunder Systems, Inc. We reserve all rights not expressly granted in these Terms.
If you provide feedback or suggestions, you allow us to use them without restriction or obligation to you.
Thunder may rely on or integrate with third-party services. We do not control those services and are not responsible for their availability, performance, security, or terms. Changes to third-party services may affect how Thunder works.
Thunder is provided on an “as is” and “as available” basis. We may change, suspend, or discontinue parts of the platform at any time, and we do not warrant that Thunder will be uninterrupted, error-free, secure, or meet your specific requirements.
To the maximum extent permitted by law, Thunder will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, or business interruption.
To the maximum extent permitted by law, Thunder’s total liability for any claim relating to these Terms or the platform will not exceed $100.
You may stop using Thunder at any time. We may suspend or terminate your access if you violate these Terms or if we believe your use creates risk for Thunder, other users, or third-party platforms. Upon termination, your right to use the platform ends.
We may update these Terms from time to time. If we make material changes, we will post the updated Terms on our website. Your continued use of Thunder after changes become effective means you accept the updated Terms.
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
